Re-Entering a Store You Have Been Banned from Is Burglary

By Jedidiah McKeehan

When someone is charged with the crime of theft, that theft usually results from the theft of goods from a store.  That theft charge is what we normally think of as shoplifting.  The Tennessee laws that discuss theft and shoplifting are Tennessee Code Annotated sections 39-14-103, 39-14-105, and 39-14-146.

If someone is charged with shoplifting, which is a way to describe a version of theft, almost always, any agreement through the court system that resolves that charge involves the defendant being permanently banned from ever returning to that store.
